ARTICLE 1 – LEGAL NOTICES AND PURPOSE

The Site provides a platform allowing Users to browse, unlock, and copy optimized instructions, data structures, and framing texts (hereinafter referred to as “Prompts“), as well as view associated visuals and descriptive overviews, intended for use with third-party artificial intelligence tools.

By accessing or using the Site, you agree to be bound by these Terms without reservation.

ARTICLE 2 – ACCESS TO THE SITE AND ACCOUNT CREATION

2.1 Free and Restricted Access

General browsing of the catalog is freely accessible. However, accessing full Prompts, one-click copying features, or interactive tools requires creating a User Account (hereinafter the “Account“) and authenticating as a User.

2.2 Registration and Credentials

When registering, the User agrees to provide accurate and up-to-date information. The User is solely responsible for maintaining the confidentiality of their login credentials. Any activity performed through the Account is deemed to have been conducted by the User. If the User suspects unauthorized use of their Account, they must immediately notify the Operator.

ARTICLE 3 – CATALOG PROTECTION AND DATABASE RIGHTS

3.1 Content Ownership

The Site, its domain name hero48.com, its layout, design, interfaces, architecture, as well as the curation, arrangement, and structuring of all Prompts, descriptions, and visuals (hereinafter the “Content“) are the exclusive property of the Operator.

3.2 Protection Against Bulk Extraction

The Prompt catalog represents a structured collection that required significant investment in time, organization, and technical resources.

Unless explicitly authorized in writing by the Operator, the following activities are strictly prohibited:

  • Mass, automated, or systematic extraction, scraping, or copying of the Prompt catalog;
  • Building a derivative database or direct competing service using the Content from the Site.

ARTICLE 4 – PROHIBITION OF SCRAPING AND AUTOMATED EXPLOITATION

The following actions are strictly prohibited across the entire hero48.com Site:

  1. Using any automated means, including bots, spiders, crawlers, or scrapers, to access, extract, index, or copy any Content, Prompts, or data from the Site.
  2. Reverse engineering, decompiling, disassembling, or attempting to intercept API calls, authentication tokens, or source code related to the Site.

The Operator reserves the right to employ technical protection measures (IP blocking, captchas, rate limiting) to enforce these restrictions.

ARTICLE 5 – USER LICENSE AND INDIVIDUAL SHARING (MANDATORY ATTRIBUTION)

The Operator encourages creative use, customization, and community sharing around the interactive games and stories offered.

5.1 Permitted Use and Individual Sharing

The User is permitted to:

  • Use and execute Prompts on any third-party AI platform of their choice;
  • Modify, adapt, or build upon an individual Prompt to create personalized variants;
  • Share an individual Prompt (original or modified) for non-commercial purposes on forums, social media, blogs, or online communities.

5.2 Mandatory Attribution (Source Credit)

Any public sharing, redistribution, or publishing of a Prompt sourced from hero48.com (or any derivative work based upon it) must explicitly attribute the source by including a clear credit line and an active hyperlink back to the Site.

Example of required attribution:

5.3 Commercial Resale Prohibition

It is strictly prohibited to resell, sublicense, repackage, or bundle the Prompts from the Site into paid products or commercial prompt packs without explicit written consent from the Operator.

ARTICLE 6 – DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

6.1 Behavior of Third-Party AI Systems

Prompts made available on hero48.com are designed to be run on third-party large language models and artificial intelligence tools (such as ChatGPT, Claude, Midjourney, etc.).

The Operator does not control these third-party platforms and shall not be held liable for:

  • Errors, inconsistencies, “hallucinations,” or unexpected outputs generated by a third-party AI as a result of using a Prompt;
  • Service interruptions, policy changes, account bans, or restrictions imposed by third-party AI providers during the execution of a Prompt.

6.2 General Limitation of Liability

The User utilizes the Prompts at their own risk and discretion. In no event shall the Operator be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, moral injury, or the generation of offensive or inappropriate content by a third-party AI) arising out of or in connection with the use or inability to use any Prompt provided on the Site.

The User is solely responsible for ensuring that the outputs generated by their chosen AI tool comply with all applicable local laws and the third-party platform’s terms of service.

ARTICLE 7 – SITE AVAILABILITY

The Operator strives to maintain the Site accessible 24/7. However, access may be interrupted, suspended, or restricted at any time without prior notice for maintenance, updates, or technical reasons, without giving rise to any right to compensation.

ARTICLE 8 – TERMINATION AND SANCTIONS

In the event of a breach of these Terms by a User (including, but not limited to, automated scraping, failure to provide required attribution upon sharing, or unauthorized commercial exploitation):

  1. The Operator reserves the right to immediately suspend or terminate the User’s Account, without prior notice.
  2. The Operator reserves the right to implement technical blocking measures and pursue appropriate remedies to stop any unauthorized activity.

ARTICLE 9 – MODIFICATIONS TO THE TERMS

The Operator reserves the right to update or modify these Terms at any time. Any changes will take effect immediately upon being posted on hero48.com. Continued use of the Site after updated Terms are published constitutes full acceptance of the revised Terms.

ARTICLE 10 – DISPUTE RESOLUTION

In the event of any claim, dispute, or controversy arising out of or relating to these Terms or the use of the Site, the parties agree to first attempt to resolve the matter amicably through good-faith informal negotiations. If the dispute cannot be resolved informally within thirty (30) days, it shall be submitted to a competent court of jurisdiction.
